LEGAL UPDATE | Vietnam Judiciary Ethics & Conduct (Effective 2026)

⚖️ On 31 December 2025, the Chief Justice of the Supreme People’s Court of Vietnam issued Decision No. 3918/QĐ-TANDTC, promulgating the Code of Conduct for persons holding positions and powers within the People’s Court system.

This Code represents a significant step in strengthening judicial integrity, transparency, and public trust. Key highlights include:
🔹 Scope of application
Applies to judges, court clerks, court officials, civil servants, employees, and other individuals performing official duties within the People’s Courts.

🔹 Core principles
– Impartiality, integrity, professionalism
– Zero tolerance for corruption, abuse of power, or conflicts of interest
– Respect for citizens’ lawful rights and interests

🔹 Conduct in judicial activities
– Cases must be handled lawfully, objectively, and within statutory timelines
– Prohibition of receiving gifts, benefits, or undue advantages related to cases
– Clear accountability and responsibility to explain decisions when required

🔹 Communication & public interaction
– Proper, respectful conduct toward litigants, lawyers, and colleagues
– No intimidation, harassment, or procedural obstruction

🔹 Digital conduct & social media
– Strict prohibition on disclosing internal or case-related information
– No unverified statements that may affect the reputation of the judiciary
– Public assets and resources must not be used for personal purposes

🔹 Leadership responsibility
Court leaders are required to lead by example, ensure fair work allocation, and prevent unlawful interference in judicial proceedings.
