It’s last Friday, Vietnam’s Ministry of Home Affairs has officially issued Circular No. 08/2026/TT-BNV guiding the implementation of Decree 337/2025/ND-CP on Electronic Labor Contracts (“e-Labor Contracts”), effective from 01 July 2026.
📌 This is not merely a procedural reform.
It signals a major shift toward:
🔹 digital workforce governance,
🔹 centralized labor data management,
🔹 AI-enabled HR compliance, and
🔹 stricter personal data protection obligations for employers and HRTech providers.
🔍 KEY LEGAL HIGHLIGHTS
✅ Centralized Electronic Labor Contract Platform
Vietnam will operate a national platform for:
• execution,
• authentication,
• management,
• storage, and
• sharing of labor contract data.
➡️ A significant step toward fully digital HR governance.
🆔 Unique ID for Every e-Labor Contract
Each electronic labor contract will receive a unique identification code linked to:
• amendments,
• renewals,
• appendices,
• salary adjustments, and
• termination records.
➡️ Enhances transparency, traceability, and dispute management.
🔐 Mandatory Digital Authentication
Employers and employees must use:
• electronic identification systems,
• digital signatures, and
• authenticated electronic accounts.
➡️ Digital identity is becoming a core compliance requirement in Vietnam.
🛡️ Stronger Data Protection & Cybersecurity Obligations
The Circular introduces strict requirements regarding:
🔹 employee data security,
🔹 access control,
🔹 audit logs,
🔹 encryption measures,
🔹 system monitoring, and
🔹 incident response mechanisms.
⚠️ HRTech, SaaS, payroll, and eContract providers should immediately review compliance readiness.
📊 Large-Scale Workforce Data Standardization
The new framework standardizes extensive labor-related data, including:
• salary information,
• workforce demographics,
• insurance participation,
• job positions,
• contract status, and
• enterprise labor statistics.
