❓ Which courts in Vietnam will have jurisdiction over arbitration-related matters, bankruptcy proceedings, and intellectual property disputes from June 2026?
On 10 June 2026, the Standing Committee of the National Assembly issued Resolution No. 04/2026/UBTVQH16, amending and supplementing several provisions of Resolution No. 81/2025/UBTVQH15 regarding the establishment and territorial jurisdiction of People’s Courts in Vietnam.
🔑 Key Highlights:
📌 1. Centralization of Arbitration-related Court Jurisdiction
The Resolution clarifies the territorial jurisdiction of provincial-level People’s Courts in relation to:
• Applications to set aside arbitral awards; and
• Registration of ad hoc arbitral awards.
Three courts are designated as key hubs:
🔹 Hanoi People’s Court – exercising jurisdiction over 18 provinces and cities.
🔹 Da Nang People’s Court – exercising jurisdiction over 7 provinces and cities.
🔹 Ho Chi Minh City People’s Court – exercising jurisdiction over 9 provinces and cities.
📌 2. Specialized Jurisdiction in Bankruptcy Matters
Regional People’s Courts in Hanoi, Da Nang and Ho Chi Minh City are assigned territorial jurisdiction over rehabilitation and bankruptcy proceedings within their respective regions.
📌 3. Concentration of Intellectual Property Cases
The Resolution centralizes jurisdiction over civil, commercial and administrative disputes relating to:
🧠 Intellectual Property Rights; and
⚙️ Technology Transfer.
This reform is expected to promote greater judicial specialization, consistency and predictability in adjudicating complex IP disputes.

The Resolution will take effect on 10 June 2026.
