❓ Can a favorable arbitral award truly protect your rights if it cannot be effectively enforced?
Winning a dispute is only part of the journey. The real value of any judgment or arbitral award lies in its enforceability.
The Law on Civil Judgment Enforcement 2025 (Law No. 106/2025/QH15) introduces an important reform by expanding the scope of enforceable decisions, reinforcing Vietnam’s commitment to strengthening judicial effectiveness and Alternative Dispute Resolution (ADR).
🔍 Key Highlights
📌 Expanded Scope of Enforceable Decisions
The new Law expressly recognizes, among others:
⚖️ Decisions of the Supreme People’s Court issued under specialized legislation;
🤝 Arbitral awards rendered under the Law on Commercial Arbitration;
📑 Certain competition-related decisions;
👥 Decisions under the Law on Juvenile Justice; and
📚 Other decisions prescribed by specialized legislation.
This broader framework enhances legal certainty and further strengthens Vietnam’s pro-arbitration environment.
🤝 Why Does This Matter?
Arbitration is valued for its neutrality, confidentiality, flexibility, and finality. Yet an award has little commercial value unless it can be effectively enforced.
The new Law reinforces confidence in arbitration while providing businesses and investors with greater certainty in post-award enforcement.
💡 THE LAM LAW – Your legal need, Our Mission‘s Insights
At THE LAM LAW, we believe that a successful dispute is not one that ends with an award, but one that ends with successful enforcement.
With extensive experience in commercial litigation, domestic and international arbitration, recognition and enforcement of arbitral awards, and post-award enforcement, our team helps clients transform legal victories into practical commercial outcomes.
Enforcement strategy should begin when drafting the dispute resolution clause—not after the award is rendered.
